Documents for diesel generator tenders in Ukraine

Short answer: For a diesel generator in a Ukrainian tender, buyers usually ask for a certificate of origin, a declaration of conformity (the manufacturer’s CE documents and, where required, a declaration under Ukrainian technical regulations), the manufacturer’s warranty letter, a technical passport and operating manual in Ukrainian, and a factory test report. During martial law, generating sets may be placed on the market without a Ukrainian declaration of conformity (CMU Resolution No. 1213/2023). In public procurement, diesel generator sets are subject to a localization requirement: 30% in 2026, 35% in 2027 and 40% from 2028, for goods worth UAH 1 million or more (since 24 August 2026).

Public buyers often add their own requirements, for example ISO certificates of the manufacturer or specific document formats. Read the tender documentation in full before you prepare the offer.

Conformity during martial law (CMU 1213/2023)

• Cabinet of Ministers Resolution No. 1288 of 16 November 2022, rewritten by Resolution No. 1213 of 17 November 2023, allows listed products to be placed on the market and put into service without a declaration of conformity and without the conformity mark until martial law ends and for 90 calendar days afterwards.
• The list includes HS 8502 electric generating sets, HS 8408 diesel engines and HS 8501 61–64 alternators. The exemption applies to the technical regulations on machinery safety (CMU No. 62), low-voltage equipment (No. 1067), electromagnetic compatibility (No. 1077) and outdoor equipment noise (No. 1186).
• The exemption concerns market surveillance. Public buyers may still require quality and conformity documents in the contract.
• A new machinery technical regulation based on Regulation (EU) 2023/1230 is expected to replace CMU No. 62 from 20 January 2027. Whether a similar martial-law exemption will apply under the new regulation was not clear at the time of writing.

Localization requirement in public procurement

• Legal basis: Law of Ukraine No. 922-VIII “On Public Procurement”, Section X, paragraph 6-1. Diesel generator sets have been on the list since the rule entered into force on 14 July 2022 (Law No. 1977-IX).
• Required localization degree: 30% in 2026, 35% in 2027 and 40% from 2028 until 31 December 2032.
• Threshold: since 24 August 2026 (amendment by Law No. 4888-IX), the rule applies when the value of the listed goods in the procurement is UAH 1 million or more. Before that date the threshold was UAH 200,000 for the subject of the procurement.
• Registration: the product must be entered in the list of localized goods by the manufacturer itself. A bid that does not meet the requirement is rejected, and a contract concluded in breach of the rule is void.
• Exceptions exist, for example for goods originating in countries that are parties to the WTO Government Procurement Agreement or that have an agreement with Ukraine covering public procurement, for certain energy-emergency purchases under CMU Resolution No. 1178 (until 31 December 2026), for the Kyiv backup-power pilot project (until 25 March 2028) and for procurements financed by international financial institutions under their own rules. Whether an exception applies depends on the tender.
• From 24 March 2027, the same rules continue under the new Law No. 4888-IX.
